The EU’s new Data Act regulation will enter into force in autumn 2025 and introduces mandatory changes to the Terms & Conditions of all service providers. We want to keep our customers informed and ensure that the use of our services continues smoothly under these new requirements.
For this reason, we have updated our license agreements and Terms & Conditions, which will take effect on September 12, 2025. Please get acquainted with our new T&Cs, which reflects these changes here.
Please be aware that these changes are necessary for us to further perform our services in compliance with the mandatory regulations. These changes will be considered accepted if our customers do not submit a written objection to us within 14 days of receiving this notice and will in turn come into effect as of 12.09.2025.
Below is a summary of the key changes:
Current Version | New Version (effective from September 12, 2025) | |
Termination of the agreement by the customer | The customer could only terminate the agreement in the event of material breach by Leadoo. | The customer can terminate the agreement at any time, with a Maximum Notice Period (two months). In this case, the Additional Fee (corresponding to the fees for the remainder of the agreement, had it not been terminated) may be charged. This fee does not apply when the customer terminates the agreement due to circumstances for which Leadoo is responsible. |
Procedure for changing service provider | Lack of detailed provisions and procedures for transferring data to another provider resulting from the Data Act. | A detailed, new chapter has been introduced that regulates the process of transferring your data and digital assets in accordance with the EU Data Act. New appendices have been added to specify the technical conditions for migration. |
If customer object to these new terms, the previous T&C will apply to the performance of the agreement. At the same time, however, we would like to point out that we will then not be able to provide services in accordance with mandatory legal provisions. Therefore, for their further performance starting from September 12, 2025, we will need to agree with the customer on the changes resulting from the Data Act, so that our agreement can remain in force and customer can continue to use our System without disruption.
